BDO BREAKROOM ON CAMPUS COMPETITION TERMS & CONDITIONs

The Promoter

The promoter is BDO Services Ltd (“BDO”, “we”, “us”) of 55 Baker Street, London W1U 7EU.

The competition
    • The title of the competition is “BDO BREAKroom social media competition(the “Competition”).
    • The Competition will require participants to use their creative skill to share a photo and/or video on TikTok and/or Instagram about their ‘BDO Break The Room’ on-campus university experience. These experiences will be hosted by the BDO Resourcing team at 10 universities across the UK in October. More details of the locations and dates can be found linked here.
How to enter
    • The Competition will run from 9am on 6 October 2024 (the "Opening Date") to 5pm on 14 November (the "Closing Date") inclusive.
    • Before the Closing Date, the participants can enter the Competition by:
      • posting either a photo or video;
      • on TikTok or Instagram;
      • with the hashtag #BDOBREAKRoom in the caption; and
      • tagging either (i) @lifeatbdouk on TikTok or (ii) @LifeAtBDO on Instagram.
    • No purchase is necessary to enter the Competition and there is no charge to register for use of the website.
    • The Promoter will not accept responsibility for Competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind.
    • By submitting a Competition entry, you are agreeing to be bound by these terms and conditions.

    • The Competition entries will be judged by a panel of judges As the winning entries are open to subjective interpretation, an independent judge may be appointed. The decision of the panel of judges (acting reasonably) will be final.
Eligibility
    • The Competition is only open to all residents in the UK aged 18 years or over.
    • In entering the Competition, you confirm that you are eligible to do so and eligible to claim any prize you may win. The Promoter may require you to provide proof that you are eligible to enter the Competition.
    • The Promoter will not accept Competition entries that are:
      • automatically generated by computer or created by artificial intelligence (including but not limited to chatbots such as ChatGPT or similar software applications); or
      • incomplete
    • There is a limit of one entry per person.
    • The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the Competition.
    • The Instagram or TikTok account used to make entries on must include the participant’s first and surname.
The prize
    • There will be an opportunity to win one of three available £100 gift card prizes (gift cards to be selected in the Promoter’s sole discretion).
    • Prizes are subject to availability. There is no cash alternative for the prize
    • The prize is not negotiable.
    • In order to claim their prize, the three winners will receive a direct message via the Instagram or TikTok account that the winning entry was shared by with details on how to claim their gift card.
Winners
    • The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.
    • The Promoter will contact the winners via their Instagram or TikTok account as soon as practicable after the Announcement Date.
    • The Promoter shall either publish or make available information that indicates that a valid award took place. By entering this Competition you agree that, if you are selected as a winner, you consent to the Promoter sharing your name, social media handle and winning entry on its website and/or in any other media.
    • The Promoter will send the surname of prize winners and, if applicable, copies of their winning entries, to anyone who emails eic_events@bdo.co.uk or writes to the address set out in clause 1 (enclosing a self-addressed envelope) provided they to do within one month after the Closing Date of the Competition.
    • If you object to your surname and winning entry being published or made available, please contact the Promoter via eic_events@bdo.co.uk. In such circumstances, the Promoter may still need to provide your information and winning entry to the Advertising Standards Authority on request.

Claiming the prize

  • If you are the winner of a prize, you will have 14 days from the Announcement Date to claim the prize by responding to your DM.
  • If you do not claim the prize by this date, your claim will become invalid.
  • The prize may not be claimed by a third party on your behalf.
  • The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not claimed their prize within 14 days of the Announcement Date, the Promoter reserves the right to offer the prize to the next eligible entrant selected from the correct entries that were received before the Closing Date.
  • The Promoter does not accept any responsibility if you are not able to take up the prize.
Limitation of liability

Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.

Ownership of competition entries and intellectual property rights
    • All Competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
    • By submitting your Competition entry and any accompanying material, you agree to:
      • assign absolutely to the Promoter all your intellectual property rights held in the competition entry with full title guarantee; and
      • waive absolutely all moral rights,

in and to your Competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

  • You agree that the Promoter may, in their sole discretion, make your entry available on its website and/or in any other media, whether now known or invented in the future, and in connection with any publicity of the Competition. You grant the Promoter a non-exclusive, worldwide, irrevocable licence in perpetuity, for the full period of the intellectual property rights in the Competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the intellectual property rights in the Competition entry and any accompanying materials for such purposes.
Data protection and publicity
    • The Promoter will only process your personal information as set out in the Privacy Policy.
    • If you have questions about this Privacy Statement or how we handle your personal information please contact the firm’s Data Protection Officer, at dpo@bdo.co.uk. We are committed to working with you to obtain a fair resolution of any complaint or concern about privacy. If, however, you believe that we have not been able to assist with your complaint or concern, you have the right to make a complaint to Information Commissioner’s Office (ICO), the UK supervisory authority for data protection issues, using their website ico.org.uk.
General
    • If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the Competition.
    • The Promoter reserves the right to hold void, suspend, cancel, or amend the prize Competition if, in its sole discretion, it considers it necessary to do so.
    • These terms and conditions are governed by English law. If any entrants to this promotion wish to take court proceedings, then they must do this within the courts in the United Kingdom.
